Judge Denies Ex-Cop’s Appeal In Case Of Haitian Migrant

Hardbeatnews, NEW YORK, N.Y., Thurs. Mar. 30, 2006: Appeals Court Judge Reena Raggi yesterday rejected a bid for the early release of a former New York City cop who has been serving a five-year sentence for his part in the horrific assault of Haitian migrant, Abner Louima.

Brooklyn Federal Court Judge Raggi disagreed with Charles Schwarz’s lawyers that their client was owed an early release under a sentencing deal struck with prosecutors in 2002.

And she insisted that Schwarz serve out his five-year term, which will run through Jan. 2007. The judge also had some harsh words for Schwarz, telling him his lack of remorse “makes me wonder if you truly understand the seriousness of what you did.”

The 39-year-old former cop at the 70th Police Precinct in Brooklyn, N.Y., was convicted of lying to authorities about the vicious sodomy with a broomstick of Louima in 1997, by another officer, Justin Volpe. Prosecutors had argued that Schwarz held Louima down while Volpe sodomized him in the bathroom of the 70th Precinct. Schwarz claims he wasn’t in the bathroom.

Ironically, earlier this month, prosecutors had contacted the Bureau of Prisons and urged that Schwarz’s sentence be reduced to 47 months.
